GTC

Validity of the GTC

These General Terms and Conditions (GTC) apply to all orders placed via the webshop at www.bergstolz.ch
The version of the GTC current at the time of the order shall apply. The contract shall be concluded exclusively in German and English.
The GTC are written in German. No responsibility is accepted for translation and comprehension errors in the English version.

Orders

The order is equivalent to the signing of the contract.
By submitting an order, the customer expressly agrees to these GTCs. All orders are binding. The availability of the ordered items is not guaranteed. If an ordered item is not in stock, the delivery of the remaining items is not affected. Missing items will not be delivered later and will be deleted from the current order. Paid but undeliverable items will be refunded.
New and foreign customers always pay in advance. Swiss regular customers, can be supplied with invoice. BergStolz has the power to decide on the adjustment of the payment method.

Delivery

Delivery times may vary and are not binding. They are subject to the delivery service providers of the various countries. Contact for this www.post.ch
Orders are generally shipped within 5 working days. Orders with the delivery service “DE-Post”, are sent once a month.
In case of package returns, the customer will be informed immediately. If the order is resent, the recipient will bear any additional shipping costs.

Price and assortment changes

We reserve the right to make price and product range changes as well as technical changes. All products offered are subject to change without notice. Errors and misprints excepted.
Furthermore, we reserve the right to make changes with regard to the Shipping costs.
For orders with the delivery service “DE-Post”, we reserve the right to charge the customer the resulting VAT of 19%.

Cancellation policy

In the event of seriously damaged goods or incorrect delivery, there is a right of recall. The buyer has the right of recall within 7 days after receipt of the delivery. BergStolz must be informed immediately in writing in order to discuss the further, individual procedure. In the event of damage caused by postal delivery, the customer must claim compensation from his post office.

Payment deadline

Orders from Switzerland on invoice are to be paid within 10 days with the enclosed payment slip. Alternatively, the account details can be viewed under “My account” – “Orders” – “Invoice”. Foreign orders will only be shipped against prepayment. An instalment purchase is possible by arrangement for loyal customers.

Privacy and data protection

BergStolz records mandatory data in order to enable a smooth processing of the order. The address data will be treated confidentially and will not be passed on to third parties in any form. Service partners such as the post office etc. are excluded from this.

Applicable law, place of jurisdiction

The legal relationships are subject to Swiss law. The exclusive place of jurisdiction for all disputes is Hinwil.
